This Agreement is a binding legal contract between Hatch Baby, Inc. (“Hatch”, “we”, “our” or “us”) and you, the user (“you”).
This Agreement becomes active from the moment you use any aspect of our Services—including browsing our websites, using our applications, or purchasing any product (the “Effective Date”). By doing so, you acknowledge and agree to comply with these Terms.
By registering or using any part of our Services, you acknowledge your agreement to these Terms and any additional rules, guidelines, or policies that may be posted or updated from time to time. Certain products or features may include specific terms that are incorporated into these Terms by reference.
These Terms apply to all users, including those contributing content, whether registered or not.
While we may share information relating to health and well-being, nothing offered by Hatch—including communication with Hatch representatives—constitutes professional medical advice or care. Relying on such content is entirely at your discretion. In case of a medical emergency, contact your doctor or local emergency services immediately.
Except for specific cases noted in the Arbitration section, you agree to resolve any disputes through individual, binding arbitration and waive the right to join any class action or group arbitration.
You confirm that you are at least 13 years old. If you are under that age, you are not permitted to use our Services. You are also responsible for ensuring that your use complies with all relevant local and international regulations. Our Services are meant for your personal use only—not for third parties.
Certain functions may require account registration. You must provide accurate, complete details and keep them current. You must not:
Use someone else’s name to mislead or impersonate.
Select a name you don’t have the legal right to use.
Choose a username that's vulgar or inappropriate.
You are fully responsible for activities under your account and for keeping your login credentials confidential. Notify us immediately if your eligibility changes, your account is compromised, or you notice unauthorized activity.
We grant you a personal, non-exclusive, limited, revocable license to access and use our Services for non-commercial purposes only.
However, this right is subject to restrictions. You may not:

Alter, reverse-engineer, or attempt to extract source code.

Future updates or additional features will also fall under these Terms. Intellectual property and copyright notices must be kept intact on all reproductions.
We are not required to offer technical support or maintenance.
Unless otherwise stated, Hatch and its licensors retain ownership of all intellectual property rights within the Services. These Terms do not transfer any ownership to you, only limited use rights. All rights not explicitly granted remain reserved.
Definition: “Content” includes all types of material—text, media, software, graphics, etc.—made available through the Services. This includes content created by users ("User Content").
Responsibility: You are accountable for anything you post or share, and you confirm that your content is lawful, accurate, and current. Hatch is not responsible for monitoring or backing up User Content, and we may remove it at any time. You should keep your own backups.
Rights You Grant Us: You allow us a global, royalty-free, irreversible license to use, reproduce, distribute, modify, and display your content within our Services. You waive any rights to claim authorship or to object to modifications.
Prohibited Use: Don’t post or share content that’s:
Infringing on rights of others.
Harmful, illegal, offensive, or misleading.
Spam or unauthorized marketing.
Containing viruses or other malicious software.
We may take action if you violate these rules, including removing content or disabling accounts.
By using our Services, you agree not to:
Violate others' intellectual property rights.
Post false or offensive content.
Engage in spamming, phishing, or virus distribution.
Attempt unauthorized access or data scraping.
Interfere with others’ use of the Services.
We reserve the right to investigate and act on any misuse of the Services and to comply with legal requests, protect users, and maintain security.
Product descriptions, prices, and availability may change without notice. Inclusion on the Site doesn’t guarantee continued availability. We may limit quantities or discontinue items at any time.
We are not liable for discrepancies in color or details due to display differences.
Paid Services: Some features require payment. Any payment terms shown during sign-up are part of this Agreement.
Free Trials: Trials must be activated within six months of device activation. Unless canceled in time, subscriptions begin automatically after the trial ends.
Renewals: Subscriptions renew monthly or yearly, depending on your plan. Cancel anytime via hatch-shop.com or by contacting support. No refunds are given for early cancellation.
Billing Info: Payments are handled via third-party processors. You must maintain up-to-date billing information. If a payment method fails or becomes invalid, we may still charge fees owed.
Replacement Policy: If requesting a replacement device, you must return the original within 30 days. If not returned, your stored payment method may be charged.
We reserve the right to terminate access to any part of the Services at any time, with or without cause or notice. Certain clauses—like intellectual property rights, disclaimers, and limitations—will remain active after termination.
The Services are offered "as is" without guarantees of performance, reliability, or availability. We disclaim all implied warranties including merchantability and fitness for a particular purpose. You assume full risk when using our Services.
We do not offer medical advice, and our products are not medical devices.
We are not liable for:
Indirect or incidental damages.
Data loss or service interruptions.
More than $500 or the amount you paid in the last 3 months—whichever is greater.
All legal disagreements must be resolved through binding arbitration. You waive the right to class actions or group arbitration. Claims must be filed within one year.
We may update these Terms or modify the Services at any time. Continued use of the Services after changes implies acceptance. It’s your responsibility to review Terms regularly.
Any suggestions or feedback you provide become our sole property, and you agree to transfer all rights to us.
By registering or making a purchase, you agree to receive emails from us, including promotional emails. You may opt out of marketing communications at any time.

This Agreement constitutes the full understanding between you and Hatch. If any clause is invalid, the rest remains enforceable. No party may assign rights without permission, except Hatch in the case of a merger or acquisition.
These Terms do not establish any employment, agency, or joint venture relationship.
